Such an arrangement is appropriate under the compact clause of the United States Constitution. In 2005, a collision between a bus and plaintiffs car occurred on Highway 159 in Belleville. Plaintiff sued defendant transit system in the circuit court of St. Clair County, claiming personal injuries.

The State appealed to the appellate court (see 210 Ill. 2d R. 604(a)). A divided panel of the appellate court reversed the circuit courts order to suppress evidence and quash arrest and remanded the cause to the circuit court for further proceedings. 395 Ill. App. 3d 194.

Defendants first jury trial in the circuit court of Will County resulted in a deadlocked jury, and the court declared a mistrial. The State then retried defendant.
